But maybe it's a Japanese 'thing' and everyone has to pay a 'Naughty fee' if they want to use smaller mosaics. Or they get special patriotism points if they use bigger mosaics with extra points if they are even in the shape of Japanese national flags, and if they reached a certain point value they get a dakimakura of their prime minister. 

I know at least a portion are probably done ironically - it's likely a case of how much the dev/artist wants to push the limit~

There is no standard whatsoever; it's left up to the artists to figure out their own interpretation of the obscenity laws and the law enforcement agency uses their own discretion to determine if something is obscene or not. The vagueness of the law means each studio will determine how much pixelation they need and often you find the higher profile the company, the larger the mosaics. Yep, it's totally fucked up. Feel free to look into the history of it and see how the US was actually responsible for telling Japan to be less obscene after WWII and they formed their own bizarre interpretation with this obscenity law that is so cemented now it seems absurd in this free-for-all Internet age.

Yeah the Americans showed up and wrote a new constitution and stuff for Japan (yes USA wrote the Japanese constitution without influence from any Japanese people). Before that the Japanese were really lax in that regard and all onsen were mixed gender. Particularly the common practice of bathing nude with a bunch of strangers of both genders was completely unacceptable to the Americans.
