Amon Posted July 13, 2016 Posted July 13, 2016 Hi there, I know it depends heavily on the particular country you live in, but did anyone ever had problems with customs when importing Dakimakura? Some of those depict loli characters with explicit nudity, so I was wondering if the import of phantasy-drawings can be persecuted. I mean, c`mon, they're not even real. The german law for example is really inconclusive. A drawing would need to be "close to reality" to be considered illegal, which leaves enough room for malicious interpretation. And even if something would be legal by law, it's still enough to get you in trouble that some customs official is in doubt and starts a ruckus. With people becoming more and more hysterical about nonsense, I'm not going to risk anything though. Not worth it.. Greetz. Quote
Nosebleed Posted July 13, 2016 Posted July 13, 2016 Yes, it can be prosecuted depending on the country. "It's a drawing" is not a legitimate defense. France and Canada, for example, define child pornography as ANY depiction of a minor, real or not. Now onto your question in specific, if the dakimakura comes inside a non transparen packaging, and inside that it's still wrapped in plastic, with the dakimakura itself being folded in a way that doesn't show the important bits, you should theoretically be fine. Nonetheless, check your local regulations and decide for yourself if you want to run the risk. Quote
KuroganeHomura Posted July 13, 2016 Posted July 13, 2016 Spend a few hours to read up on the laws in your country, previous cases concerning whatever you're thinking of importing specifically, legal opinions by lawyers, as well as any laws concerning imports. Even if something is legal to own, it may still be illegal to import. Quote
Narcosis Posted July 13, 2016 Posted July 13, 2016 You should be fine in case of Germany and most southern and mid/east-european countries, which tend to have a lot less stricter (or no) law regulations when it comes to pornography/obscene content in general. If I remember correctly, Germany tends to be a lot stricter in terms of excessive violence, rather than erotic content. That said, there's more or less no difference between countries, when it comes to fictional child pornography; you either have it completely illegal, illegal regardless whether real or not, illegal if 'real enough', or not monitored and that doesn't necesarilly mean you're free to import it without risk. You simply have a lot less of a chance, someone will actually bother to consider it 'illegal', when it's just a drawn pic of Rika with cat ears and tail, undressed and lying on bedsheets in a rather dubious pose . TexasDice Posted July 13, 2016 Posted July 13, 2016 Rule of thumb; Problems in germany get rougher the farther south you go. Bavaria is a big no-no for example. Quote

It's not that bad. The Zoll barely ever looks at what exactly you ordered as long as they see that it's the same which is mentioned on the invoice (yes in bavaria). And as far as I'm aware: as long as you're allowed to own it you're allowed to buy/import it. if neccessary you just have to take it out of the package in a way they don't see the possibly problematic parts if they even ask you to take it out sometimes they just see: seems to be the same as it is on the invoice, no need to waste more time on that one (They aren't allowed to open the package, you have to come and open it).
